General Terms

These General Contractual Conditions are intended to establish the terms and conditions governing the provision of services by the company Vivências Rurais, Lda, headquartered at Rua de Santa Catarina, nº 117, 9500-240 Ponta Delgada, registered at the Conservatória do Registo Commercial de Ponta Delgada, with the tax number 513188800.
 

  1. These General Conditions govern the terms on which services are offered to customers. These Particular Conditions prevail over any Special Conditions for a given service and, over both Conditions, others stipulated expressly in writing between Vivências Rurais, Lda and the client. When purchasing a service the customer accepts all the established terms and conditions.
     
  2. Payment terms may vary according to the service provided. In the absence of particular conditions, the general conditions apply, under which the customer must pay 50% of the total price of the accommodation at the time of booking and the remainder 14 days before the check-in act.
    1. If the reservation is made less than 14 days before the check-in date, the total price will be paid at the time of booking.
    2. A reservation can be canceled by Vivências Rurais, Lda if there are payments not made by the customer under the conditions described above.
       
  3. If the cancellation is communicated less than 14 days before the start of the service, there is no refund. In addition, once the stay has started, the customer is not entitled to any refund for unused services.
     
  4. If the cancellation is communicated at least 14 days before the start of the service, the amount already paid will be fully refunded, deducting any transaction costs that have to be borne by Vivências Rurais, Lda.
     
  5. Value Added Tax is included in the price of the service.
     
  6. Whenever there are reasons that justify it, the accommodation unit can be replaced by another of the same or higher category, by means of a written agreement with the client and without an increase in the price paid by the client.
     
  7. If unforeseen circumstances compel Vivências Rurais, Lda to cancel a reservation without the Client having breached his duties, or if the Client does not accept a change to his reservation within the scope of paragraph 5 of these Conditions, the Client will be entitled to full refund of amounts paid.
     
  8. The stay of a child up to 2 years of age is not charged, as long as it is in the same accommodation unit as the adults responsible for them. The stay of a child aged 3 to 5 years in an extra bed is charged at a lower rate than the extra bed for older guests. However, the client must always inform Vivências Rurais, Lda about the inclusion of children in their reservation. The acceptance of the reservation may be subject to the number of cots and / or extra beds available, as well as the space available in the accommodation unit.
    1. It is the customer's full responsibility to inform the number of people (adults and children) who will occupy the accommodation unit. In the event of more people than booked, the entry may be refused without refund.
       
  9. Check-in time is 14:00. Check-out time is 11:00. Exceptions may be allowed, as long as they have no effect on other reservations and / or on the cleaning work of the accommodation unit.
     
  10. Refeições - Vivências Rurais, Lda. Offers BB accommodation, but does not provide meals.
     
  11. Pets are not accepted except guide dogs.
     
  12. The client is obliged to indemnify Vivências Rurais, Lda for any damages caused to the accommodation unit and / or the respective support facilities, as well as any damages arising from the breach of the duties provided for in these general conditions, including, in particular, lawyers' fees and costs judicial.
     
  13. before check-in, the customer will be able to pay for the services via bank transfer and PayPal. After check-in, he will be able to pay for the services in cash.
     
  14. Vivências Rurais, Lda reserves the right to change these General Conditions at any time.
     
  15. In the event of a consumer dispute, the consumer can use the European Online Dispute Resolution Platform, available at ec.europa.eu/consumers/odr or the alternative consumer dispute resolution entities.

  16. For the resolution, by judicial means, of all disputes arising from this contract, namely those related to its interpretation, execution, non-compliance, invalidity, resolution or reduction, in which it was not possible to reach an amicable solution, the jurisdiction is stipulated Ponta Delgada District, with express waiver of any other.
